SB 986- Specifies that vice chairperson of Willamette River Cleanup Authority is selected by majority of members. Requires Willamette River Cleanup Authority to hold public meetings at least twice each year. Allows majority of members to call additional meetings.
SB 987- Removes sunset on pilot education service districts. Allows existing pilot education service districts to organize as shared governance education service districts. Establishes process by which education service district may organize to be shared governance education service district. Deletes requirement that districts biennially report to interim legislative committees. Declares emergency, effective on passage.
SB 988- Creates Task Force on School Reform. Directs task force to study reform of kindergarten through grade 12 public education and make recommendations for reform. Declares emergency, effective on passage.
SB 989- Eliminates requirement that both issue of representation by labor organization and issue of designation of organization as exclusive representative be placed on same ballot for representation elections for faculty of certain universities. Declares emergency, effective on passage.
SB 990- Modifies definition of “emergency benefit period” to begin on first week that begins at least 14 days after effective date of Act and ending when total of Oregon emergency benefits paid reaches $19 million. Adjusts maximum Oregon emergency benefits individual may receive to 23 percent of individual’s most recent regular unemployment benefit claim. Authorizes Employment Department to adopt rules providing for eligibility period for purpose of extended benefits if federal law provides for greater than 50 percent funding of extended benefits. Declares emergency, effective on passage.
SB 991- Exempts providers of certain parental respite services from regulation by Department of Human Services.
Makes providers of certain parental respite services mandatory child abuse reporters. Declares emergency, effective on passage.
SB 992- Allows beverage distributors or importers to establish distributor cooperative for certain purposes. Provides that dealer that uses distributor cooperative is not required to return beverage containers to distributor or importer that does not participate in distributor cooperative.
SB 993- Requires payday lenders and title lenders to obtain license to conduct business. Specifies requirements for licensing. Specifies duties and prohibitions for licensees. Sets allowable rate of interest for payday loans and title loans.
Provides that Director of Department of Consumer and Business Services may investigate licensee compliance with provisions of license and enforce licensee duties and prohibitions. Declares emergency, effective on passage.
SB 994- Requires Director of Department of Consumer and Business Services to prescribe pilot program in which small employer groups offer healthy behavior dividends that are exempt from rate variation requirements. Sunsets January 2, 2016. Declares emergency, effective on passage.
SB 995- Allows facilities that generate electricity by using biomass or combusting municipal solid waste to comply with renewable portfolio standard under certain conditions. Specifies conditions under which State Department of Energy may certify facilities as eligible for renewable energy certificates. Authorizes full recovery of costs by public utilities in prudent energy investments related to planning, financing, construction and operation of hydrogen power stations.
SB 996- Expands protection under public employee Whistleblower Law to include discussions with member of elected governing body of political subdivision in state. Declares emergency, effective on passage.
SB 997- Modifies description of certain lands, defined as “resource lands,” from which development may be transferred. Declares emergency, effective on passage.
SB 998- Modifies date by which Secretary of State must submit report to Legislative Assembly regarding cross-nomination system for candidates for public office. Conforms certain laws relating to double majority voting requirements in property tax elections to Oregon Constitution so that double majority requirement does not apply to local property tax measures submitted to electors in elections held in May or November of any year. Takes effect on 91st day following adjournment sine die.
SB 999- Modifies circumstances under which current or former member of Armed Forces, Reserves or National Guard may be offered diversion from criminal prosecution. Declares emergency, effective on passage.
SB 1000- Directs Department of Transportation, upon request, to identify veterans on driver licenses and identification cards. Permits department to waive customized registration plate fee for persons with Congressional Medal of Honor registration plates.
SB 1001- Makes application of automatic renewal provision in consumer contract or promotional or free trial offer unlawful trade practice unless provision or offer complies with notice and express consent requirements. Makes charging early termination fee for cancellation of consumer contract unlawful trade practice unless charging complies with notice and express consent requirements. Declares emergency, effective on passage.
SB 1002- Increases annuity coverage by Oregon Life and Health Insurance Guaranty Association from $100,000 to $250,000. Declares emergency, effective upon passage.
SB 1003- Authorizes Director of Department of Consumer and Business Services to grant exemption from 95 percent retention rate requirement for association health plan according to rules adopted by director. Declares emergency, effective on passage.
SB 1004- Revises scope of practice of limited access permit dental hygienists. Declares emergency, effective on passage.
SB 1005- Authorizes Housing and Community Services Department to contract to provide compliance monitoring or other administrative functions regarding housing developments and affordable housing.
SB 1006- Modifies circumstances under which owner of place of public assembly or health club is required to have automated external defibrillator on premises. Removes certain prerequisites to limitation of liability relating to use and possession of automated external defibrillator. Declares emergency, effective on passage.
SB 1007- Modifies class of inmates eligible for increased reduction in term of incarceration for appropriate institutional behavior and participation in, or completion of, certain educational programs. Sunsets increase on July 1, 2013. Prohibits Department of Corrections from initiating resentencing proceedings related to increased reduction in term of incarceration unless and until increased reduction may result in earlier release of inmate from physical custody. Declares emergency, effective on passage.
SB 1008- Modifies circumstances under which person convicted of felony may obtain relief from prohibition against possession and transfer of firearms. Modifies firearms provisions related to commitment of person with mental illness.
Eliminates requirement that forfeiture counsel send copy of judgment to Asset Forfeiture Oversight Advisory Committee. Declares emergency, effective on passage.
SB 1009- Prohibits use of plastic bags as checkout bags. Allows Department of Environmental Quality to impose civil penalty. Repeals statute requiring retail establishments that offer plastic bags to customers to also offer paper bags. Declares emergency, effective on passage.
SB 1010- Requires person practicing as surgical technologist to obtain registration from Oregon Health Authority. Prohibits employer from hiring or contracting with unregistered surgical technologist except in certain circumstances.
Establishes standards and registration requirements for surgical technologists. Imposes civil penalty for certain violations by health care facility or person practicing as surgical technologist. Declares emergency, effective on passage.
SB 1011- Requires certain employers to offer annual seasonal influenza vaccinations at no cost to licensed health care employees. Declares emergency, effective on passage.
SB 1012- Classifies certain waters of Columbia River to be used for specific purposes. Reserves specified amount of Columbia River natural flows for in-state use and classifies for specific purposes. Declares management policy for Columbia River. Imposes duties and restrictions on state agencies and public corporations regarding granting and regulation of water use in Columbia River and tributaries. Grants Water Resources Commission rulemaking authority.
SB 1013- Provides that requirement to provide certain notices to tenant of foreclosed property applies only to residential tenant. Prescribes form of required notice. Provides that if tenant elects to apply prepaid rent or security deposit to tenant’s rent obligation, purchaser at trustee’s sale is not responsible for return of security deposit or prepaid rent to tenant. Declares emergency, effective on passage.
SB 1014- Clarifies that state board or commission may meet through telephone or other electronic means. Provides that member who attends meeting through telephone or other electronic means is not entitled to compensation or reimbursement for expenses. Modifies terms of office, compensation and reimbursement for expenses for members appointed to certain public bodies. Removes President of Senate and Speaker of House of Representatives from Fujian Sister State Committee. Declares emergency, effective on passage.
SB 1015- Describes proposed boundary change as change that has not become final or effective on or before March 31 and that is certain to become final or effective before July 1 of same year or that is subject to voter approval in election held before July 1 and becomes final or effective before July 1. Applies to property tax years beginning on or after July 1, 2010. Exempts from ad valorem taxation certain communications equipment, emergency response equipment and other tangible personal property used primarily to respond to shipboard fires or oil spills in navigable waters. Applies to property tax years beginning on or after July 1, 2010. Exempts from ad valorem taxation property used for other than housing or residential purposes that is part of multiple-unit housing approved for exemption before August 26, 2009, for tax year beginning before July 1, 2009. Directs payment of refunds with interest. Sunsets January 2, 2020.
Takes effect on 91st day following adjournment sine die.

SB 1017- Creates exception to maximum loan amount permitted from Oregon Business Development Fund for certain applicants proposing business development projects. Increases maximum amount of loan that may be approved by Director of Oregon Business Development Department. Expands eligibility for entrepreneurial development loan to include any business already operating. Increases maximum amount of annual revenue business may have for purpose of loan eligibility. Changes collateral requirement for entrepreneurial development loan. Appropriates moneys from Tax Amnesty Fund to Oregon Business Development Department. Sunsets June 30, 2011. Declares emergency, effective on passage.
SB 1018- Authorizes law enforcement agencies to establish sobriety checkpoints. Takes effect only if Senate Joint Resolution 43 (2010) is approved by people at next regular general election. Takes effect on effective date of constitutional amendment proposed in Senate Joint Resolution 43 (2010).
SB 1019- Eliminates required contribution for statewide multimodal study after December 31, 2009. Makes technical correction to law governing allocation of amounts generated by increases in vehicle registration fees. Alters requirements for low-speed vehicle and medium-speed electric vehicle safety standards. Provides that moneys received by Oregon Historical Society from issuance of Pacific Wonderland registration plates may be used for purposes other than establishing and maintaining Oregon History Center at State Capitol. Requires that, under certain circumstances, photo radar sign indicate school is in session. Expands scope of variance permits. Restricts requirement that parents and other persons responsible for safety and welfare of child who is under 16 years of age secure child with safety system, safety belt or safety harness when child operates or is passenger in or on certain all-terrain vehicles to operation of vehicles on public lands. Directs Department of Transportation to submit quarterly report on revenue raised from certain increased fees and taxes. Declares emergency, effective on passage.
SB 1020- Deletes definition of “applicant” for purposes of certain provisions related to removal-fill permitting
program. Declares emergency, effective on passage.
SB 1021- Requires applicants seeking to construct certain energy facilities to enter into written agreement with state agency in which applicant agrees to compensate agency for costs associated with agency review and evaluation of applications for certain permits, authorizations and certifications before applicant may be granted permit, authorization or certification. Creates exceptions. Specifies costs for which state agency may seek compensation. Requires state agency to provide applicant with detailed account of certain costs upon request of applicant. Declares emergency, effective on passage.
SB 1022- Authorizes City of Junction City to provide water and sewer services to existing uses on certain parcels outside urban growth boundary incident to extension of services to state institution in urban growth boundary.

SB 1023- Specifies that State of Oregon waives all claim to title to certain lands. Recognizes private ownership of those lands. Declares emergency, effective on passage.

SB 1025- Requires Building Codes Structures Board and Residential and Manufactured Structures Board to adopt radon mitigation standards for certain buildings. Requires Real Estate Agency to develop information concerning radon in one and two family dwellings and to make information available to potential buyers of one and two family dwellings by
specific date. Declares emergency, effective on passage.
SB 1026- Allows Oregon Liquor Control Commission to place restrictions on license of premises that experiences
specified problems for purpose of preventing continuation of problems. Creates exception.
SB 1028- Directs Department of Corrections to determine residency status of inmates in custody of department for purposes of legislative and congressional redistricting. Directs Legislative Assembly or Secretary of State, as applicable, to adjust United States Census Bureau data to reflect permanent residence status of inmates before beginning redistricting process. Directs Legislative Assembly or Secretary of State, for purposes of redistricting, to consider
resident inmate at location of permanent residence and not at location of facility in which inmate is physically located.

SB 1029- Requires Director of Department of Consumer and Business Services to order insurer to pay attorney fees and costs to consumer representative that contests health insurance premium rate filing and substantially contributes to final order of director. Requires director to determine if premium rates proposed by insurer for health benefit plans for small employers and individual health benefit plans satisfy specified criteria. Removes authority of director to exempt from public disclosure rate filing materials of health benefit plan carriers. Declares emergency, effective on passage.
SB 1030- Requires State Forestry Department, upon request and consent of purchaser, to modify forest product sales contract by extending deadlines for forest product harvesting. Creates exceptions. Applies to forest product sales contracts entered into before January 1, 2010. Sunsets January 2, 2020. Declares emergency, effective on passage.
SB 1031- Modifies requirements for siting destination resorts. Declares emergency, effective on passage.
SB 1032- Creates unlawful practice of manufacturing, distributing or selling liquid or food in container made with bisphenol A if liquid or food is intended primarily for consumption by child under three years of age. Creates unlawful practice of manufacturing, distributing or selling container made with bisphenol A if container is designed to be filled with liquid or food intended primarily for consumption by child under three years of age. Takes effect January 1, 2012.
SB 1033- Requires schools to have automated external defibrillators on premises. Declares emergency, effective on passage.
SB 1034- Exempts first $2,400 in unemployment compensation from Oregon personal income tax for tax years beginning on or after January 1, 2009, and before January 1, 2010. Removes exception to connection to federal law for purposes of tax treatment of unemployment compensation benefits. Takes effect on 91st day following adjournment sine die.
SB 1035- Directs specified state agencies, boards and commissions to report to Legislative Assembly or Emergency Board on plan to abolish agency, board or commission or merge with another agency, board or commission. Directs specified state agencies, boards and commissions to report to Legislative Assembly or Emergency Board on plan to reduce funding level of agency, board or commission by specified percentage below legislatively approved budget for agency, board or commission for biennium beginning July 1, 2009. Directs specified state agencies to maintain expenditures at level equal to level of legislatively approved budget for agency for biennium ending June 30, 2009. Suspends cost-of-living increases, salary step increases, upward reclassifications, filling of vacant positions, creation of new positions and out-of-state travel for employees of specified state agencies. Suspends purchases of additional goods or supplies. Declares emergency, effective on passage.
SB 1036- Reauthorizes establishment of guest ranches on land zoned for exclusive farm use in eastern Oregon. Deems guest ranches established under sunsetted law to be conforming use under new authority for guest ranches. Declares emergency, effective on passage.
SB 1037- Directs each state agency to report to Legislative Assembly and Emergency Board on programs provided by agency, percentage of agency moneys expended on each program, source of moneys expended for each program and whether agency rates program as high, medium or low priority. Requires filing of report not later than 60th calendar day after effective date of Act. Declares emergency, effective on passage.
SB 1038- Creates Task Force on Core Government Functions. Sunsets task force on date of convening of next regular biennial legislative session. Declares emergency, effective on passage.
SB 1039- Allows for-profit private club to qualify for full on-premises sales license for alcoholic liquor. Eliminates statutory criteria for nonprofit private club to qualify for full on-premises sales license. Allows issuance of full on-premises sales license to nonprofit private club qualifying under Oregon Liquor Control Commission rules.
Applies to licenses issued or renewed 90 or more days after effective date of Act. Declares emergency, effective on passage.
SB 1040- Directs Office for Oregon Health Policy and Research to establish and maintain universal provider registry and provide Department of Human Services, Oregon Health Authority and Home Care Commission with access to registry. Precludes use of public funds to support employment of care providers not enrolled in registry.

SB 1041- Provides that certain personal property deposited, left or displayed in area under state ownership may be declared public nuisance. Allows agency, without notice, to remove personal property if property poses risk to public health, safety or welfare. Requires notice before agency may remove personal property that does not pose such risk. Modifies provisions related to removal of personal property deposited, left or displayed on state
highway. Declares emergency, effective on passage.
SB 1042- Removes prohibition against local government imposition of taxes on cigarettes and tobacco products. Applies to cigarettes and tobacco products distributed on or after effective date of Act. Takes effect on 91st day following adjournment sine die.
SB 1043- Allows legislative staff to explain vote of member of Legislative Assembly on measures referred to voters.

SB 1044- Increases percentage of federal earned income credit allowable as credit against Oregon personal income tax in each of four consecutive tax years. First applies to tax years beginning on or after January 1, 2011.
SB 1045- Limits use of credit history for employment purposes to certain circumstances. Creates unlawful employment practice for violation. Declares emergency, effective on passage.
SB 1046- Authorizes Oregon Medical Board to issue certificate of prescriptive authority to certain licensed psychologists and sets forth requirements and procedure for issuance of certificate. Directs board to adopt rules for regulation of prescribing psychologists with concurrence of State Board of Psychologist Examiners. Establishes Committee on Prescribing Psychologists to review applications and proposed clinical training programs, adopt formulary and make recommendations to Oregon Medical Board. Declares emergency, effective on passage.
SB 1047- Exempts from premium assessment premiums earned on health plan policies delivered or issued for delivery outside Oregon. Declares emergency, effective on passage.
SB 1048- Establishes Oregon Teacher Effectiveness and Career Enhancement Initiative Program within Department of Education. Describes application process and other requirements of program. Declares emergency, effective on passage.
SB 1049- Establishes, for purposes of Ballot Measure 49 (2007), criteria for determining what was lawfully permitted when certain claimants acquired property. Modifies provisions related to time limit for acting on relief under Ballot Measure 49 (2007). Allows claimant that did not comply with certain filing requirements, including claimant that
filed claim only with county and not with both county and state, to pursue relief under this Act. Requires Department of Land Conservation and Development to issue final order on or before specified date. Requires fee of $2,500 for processing of certain claims. Increases limit on biennial expenditures from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by Department of Land Conservation and Development. Declares emergency, effective on passage.
SB 1050- Prohibits public body from providing public subsidy for purpose of constructing, reconstructing, renovating, altering, maintaining or repairing, or entering into contract to construct, reconstruct, renovate, alter, maintain or repair, structure on real property unless iron, steel and manufactured goods used in structure are made within United States. Provides that prohibition does not apply if public body or contracting agency finds that amount or quality of iron, steel or manufactured goods made within United States are insufficient or if applying prohibition would increase cost or contract price by more than 25 percent.
SB 1051- Establishes Oregon Other Funds Reserve Fund. Transfers portion of June 30, 2011, ending balance from dedicated or continuously appropriated Other Funds accounts or funds to reserve fund. Transfers interest from reserve fund to State School Fund. Specifies circumstances under which amounts transferred to reserve fund may be modified or appropriated. Directs state agencies to follow generally accepted accounting practices relating to fund balance reporting and governmental fund type definitions. Takes effect July 1, 2011.
SB 1052- Declares provision in motor carrier transportation contract that indemnifies indemnitee against liability for acts of indemnitee to be against public policy and void. Declares emergency, effective on passage.
SB 1053- Requires public utilities and consumer-owned utilities to disclose information to customers on costs of compliance with environmental regulations, rules and laws.
SB 1054- Exempts rural airports from requirement to pay portion of grant or loan received from Multimodal Transportation Fund for statewide multimodal study. Permits Oregon Transportation Commission to provide grants or loans from Multimodal Transportation Fund to rural airports for certain transportation projects already completed or under construction. Declares emergency, effective on passage.
SB 1055- Modifies authority for establishment of winery and for winery sales and services in exclusive farm use zone. Declares emergency, effective on passage.
SB 1056- Directs Legislative Assembly to review state agencies and programs, taxes and fees administered by state agencies every six years. Abolishes state agencies that are not continued by legislative Act enacted during year of review. Establishes Sunset Advisory Commission. Directs commission to review and evaluate state agencies and programs, taxes and fees administered by state agencies, and make recommendations on abolition or continuation of agencies and programs, taxes and fees administered by agencies. Provisions requiring review of state agencies and programs, taxes or fees administered by state agencies become operative January 1, 2012. Prohibits abolishment of state agency under Act until earlier of review of agency by Legislative Assembly or 2019.
SB 1057- Declares that certain State Department of Fish and Wildlife or Water Resources Department terms, conditions or requirements for installation of fish screens, by-pass devices or fish passages are unenforceable against owners or operators of hydroelectric projects exempted from federal regulation and located within existing artificial delivery systems. Provides that hydroelectric projects exempted from federal regulation and located within existing artificial delivery systems are not subject to additional requirements for fish screens, bypass devices or fish passages if projects do not create change in stream conditions that adversely affects
fish. Limits additional requirements for fish screens, by-pass devices or fish passages for other hydroelectric projects exempted from federal regulation and located within existing artificial delivery systems. Declares emergency, effective on passage.
SB 1058- Sets limits on amounts that may be received by candidates and political committees. Prohibits corporate and labor organization contributions directly from treasury funds. Provides civil penalties to be imposed by Secretary of State or Attorney General for violations. Takes effect on 91st day following adjournment sine die.
SB 1059- Creates process for adoption and implementation of plans for reducing greenhouse gas emissions caused by motor vehicles with gross vehicle weight rating of 10,000 pounds or less. Directs Department of Transportation and Department of Land Conservation and Development to report progress and recommendations for future actions to Seventy-seventh Legislative Assembly. Declares emergency, effective on passage.
SB 1060- Establishes public right to recreational use of certain waterways. Specifies extent and limitations of right. Limits liability of owners of property immediately adjacent to waterways. Requires Department of State Lands to work with Department of State Police and other agencies to resolve issues related to recreational use of waterways. Punishes violation of statute or rule regulating public access to waterways by fine of up to $360. Declares emergency, effective on passage.
SB 1061- Allows Adjutant General to continue term if federal recognition of Adjutant General is withdrawn because of age. Sunsets January 2, 2014. Declares emergency, effective on passage.
